How the Colorado formula works

Colorado C.R.S. §14-10-114(3)(b) provides an advisory guideline formula for spousal maintenance, effective January 1, 2014:

Amount: 40% of the higher earner's monthly adjusted gross income (MAGI) minus 50% of the lower earner's monthly MAGI. If the result is zero or negative, no maintenance is indicated by the guideline.

The guideline applies when combined gross income does not exceed $240,000 per year. Above that threshold, courts use the guideline as a reference and apply additional factors.

Duration is also guideline-based and is roughly proportional to the length of the marriage (approximately 30% of the marriage length in months, per the published Judicial Branch advisory schedule). Courts frequently deviate from the duration guideline.

Frequently asked questions

What is MAGI for Colorado maintenance? Monthly adjusted gross income is your gross income minus federal above-the-line adjustments such as IRA contributions, student loan interest, and alimony paid under a pre-2019 agreement.

Is the Colorado formula mandatory? No — it is explicitly advisory. Courts weigh it alongside other statutory factors including the marital standard of living, each spouse's financial resources, and the time needed for the recipient to become self-supporting. Actual awards often differ from the guideline.
