How North Carolina calculates alimony

North Carolina has no statutory formula for alimony (post-separation support or alimony). Under N.C.G.S. §50-16.3A, the court considers 16 statutory factors — including the marital misconduct of the parties, each spouse's earnings and earning capacity, age, health, the standard of living during the marriage, and the duration of the marriage — and awards whatever amount and duration it finds equitable.

Dependent vs. supporting spouse

Alimony is payable only to a dependent spouse (one who is actually dependent on the other for support or substantially in need of maintenance) from a supporting spouse. If both spouses are self-supporting, or if the dependent spouse's own conduct bars entitlement, no alimony is awarded.

Duration and termination

  • There is no statutory duration cap in North Carolina; the court orders a "reasonable period" based on the factors.
  • Alimony ends on the dependent spouse's remarriage or cohabitation, or on the death of either spouse.
  • Courts may order alimony for a fixed term or, in longer marriages, for a longer period as justice requires.

Frequently asked questions

Does North Carolina have an alimony formula? No. N.C.G.S. §50-16.3A lists factors, not percentages. There is no calculator that produces a presumptive amount — this tool is illustrative only.

Does cohabitation end alimony? Yes. If the dependent spouse cohabits with another adult in a relationship resembling marriage, the supporting spouse can move to terminate alimony.

Is marital misconduct relevant? Yes. Illicit sexual behavior during the marriage can bar a dependent spouse from receiving alimony or require a supporting spouse to pay, depending on the circumstances.
