How New York workers' comp schedule of loss works

New York uses a Schedule of Loss of Use (SLU) for injuries to extremities (arm, leg, hand, foot, eye, finger). The schedule assigns a number of weeks of benefits for total loss of a body part, and partial loss pays a proportion of those weeks at your weekly compensation rate (two-thirds of your average weekly wage, subject to the state maximum).

For non-scheduled injuries (back, neck, whole-body, or injuries that do not fit the extremity schedule), New York awards are based on loss of wage-earning capacity and can be subject to statutory caps or lifetime benefits in severe cases. Many New York cases are resolved through a Section 32 settlement — a lump-sum agreement approved by a Workers' Compensation Law Judge that closes the claim in exchange for a negotiated payment.

Frequently asked questions

What is a Section 32 settlement? A Section 32 settlement is a lump-sum workers' comp settlement in New York approved by a Workers' Compensation Law Judge. Once approved, you generally give up the right to reopen the case for future medical or wage benefits.

How are scheduled injuries paid? The schedule assigns weeks of benefits by body part (for example, total loss of an arm). Partial loss pays the same percentage of those weeks. Your weekly rate is two-thirds of your average weekly wage, up to the state maximum.

How long do I have to file? You must notify your employer within 30 days of the accident and file a claim with the New York State Workers' Compensation Board generally within 2 years of the accident or the last payment of compensation.
